Incorporate Retaliation Risk as part of the Compliance Risk Assessment

How can organizations assess how prevalent retaliation is within their organizations’ cultures? Can they estimate how much reporting is suppressed due to fears of retaliation?

My latest article in the September issue of CEP Magazine explores whether organizations are truly evaluating their compliance with various laws and regulations related to retaliation. Though regulations and guidance originate from varied agencies and government entities, they all focus on protecting employees’ ability to report issues free from the chilling impact of retaliation. A common misconception is that the prevalence of retaliation is measured solely by the frequency of internal retaliation reports. Lower rates or infrequent internal reports of retaliation do not equate to a robust speak-up culture.
